Seller Terms and Conditions

Made in Eureka Springs – Local Artists & Artisans in Eureka Springs, Arkansas

Effective Date: June 1, 2026

By registering as a Seller, you agree to comply with both the Terms and Conditions provided at madeineurekasprings.com and the terms stated below.

 

1. Eligibility and Verification

1. Sellers must be artists or artisans based in Eureka Springs, Arkansas.
2. Made in Eureka Springs reserves the right to request proof of local residency or artist/artisan status at any time.
3. Sellers may not sell products on behalf of non-local artists or third parties.
4. Sellers must be 18 years of age or older.

 

2. Seller Obligations

Sellers agree to:

1. Accurate Product Listings: Provide truthful, complete, and clear descriptions, pricing, and images of all products.
2. Legal Compliance: Ensure all products comply with federal, state, and local laws, including safety, intellectual property, and consumer protection laws.
3. Order Fulfillment: Process and ship orders promptly according to the marketplace’s standards (see Section 7 below).
4. Customer Service: Respond to buyer inquiries in a timely and professional manner.
5. Dispute Resolution: The Seller is encouraged to resolve any disputes directly with the buyer.
6. Prohibited Items: The seller will not list or sell any prohibited, illegal, or restricted products as outlined in the marketplace Terms and Conditions (defined in Section 4 below).
7. Account Security: The Seller is responsible for maintaining the security of their seller account credentials.

 

3. Intellectual Property

1. Sellers retain ownership of their original work but grant Made in Eureka Springs a non-exclusive license to display, promote, and sell their products on the platform.
2. Sellers agree to allow Made in Eureka Springs to use imagery and media of any products for promotional, advertising, or other marketing purposes.
3. Sellers represent that their products and listings do not infringe on any third-party intellectual property rights.
4. Sellers agree to indemnify Made in Eureka Springs for any claims arising from alleged IP infringement related to their products.

 

4. Handmade Goods Policy
All products must be handmade, hand-crafted, or materially transformed by the Seller.

• Permitted categories include:
• Visual art (paintings, drawings, photography, or prints)
• Handmade jewelry
• Textiles and sewn goods
• Fiber art (crochet, knit, weaving, needlepoint)
• Woodwork, ceramics, glass, and similar crafts
• Musical Instruments
• Music written and performed by the Seller
• Print media (books and downloadable documents)
• Prohibited products:
• Mass-produced products (including CNC-produced and 3D-printed products)
• AI-produced products
• Resale/wholesale items
• Drop-shipped products
  
• All food or ingestible items - no exceptions
• Any liquids, soaps, salves, oils, or similar products applied to skin, hair, or any other part of the body – no exceptions
• Pornographic, explicit, or violent content

Made in Eureka Springs may request proof of production.

 

5. Seller Liability and Indemnification

1. Sellers are solely responsible for:
• The quality, legality, safety, and authenticity of their products
• Accurate fulfillment of orders, including shipping, packaging, and delivery
• Compliance with all applicable laws and taxes
2. Indemnification: Sellers agree to defend, indemnify, and hold harmless Made in Eureka Springs, its affiliates, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:
• Their products or services
• Misrepresentation or violation of the Terms and Conditions
• Customer disputes or complaints related to Seller products or actions

 

6. Marketplace Liability Limitation

1. Made in Eureka Springs acts solely as a platform connecting buyers and Sellers.
2. The marketplace is not responsible for:
• Product defects, damages, or misrepresentation
• Buyer or Seller misconduct
• Losses arising from delayed, damaged, or undelivered shipments
• Intellectual property theft or impersonation
3. Sellers acknowledge and agree that the marketplace’s liability is limited as described in the main Terms and Conditions.

 

7. Order Fulfillment and Shipping

• Sellers are responsible for shipping products to buyers within three business days of order receipt.
• Seller can fulfill shipping their order with any carrier of their choice.
• It is HIGHLY RECOMMENDED to use a carrier that provides tracking. The seller will be able to enter the carrier and tracking information when fulfilling the order in the seller portal. This information is sent automatically to the buyer.
• Made in Eureka Springs is not responsible for lost, damaged, or delayed shipments.

 

8. Termination and Suspension

1. Made in Eureka Springs may suspend or terminate Seller accounts for violations of the Terms and Conditions.  A Seller may be terminated immediately for any of the following reasons:
1. Violation of the Handmade Goods Policy
2. Residency misrepresentation or unreported change of residency to outside of Eureka Springs, Arkansas
3. Attempted or actual sale of prohibited items
4. Legal violations
5. Failure to fulfill orders in accordance with section 7 above
6. Repeated order rejections
7. Repeated credit card chargebacks or returns
8. Excessive or repeated customer complaints or negative feedback from customers
9. Failure to remit Marketplace subscription fee.

 

9. Seller Account Termination

1. Sellers may close their account at any time but remain liable for obligations incurred before termination.
2. Any funds owed to the Seller before account termination will be paid out after the account has been closed and any remaining financial obligations have been settled.
3. All Seller products and profiles present on the website will be deactivated. Imagery and media used for undistributed marketing purposes will be removed.

 

10. Governing Law

These Terms and Conditions are governed by the laws of Arkansas. Any disputes will be resolved in the courts of Eureka Springs, Carroll County, and the State of Arkansas.

 

11. Acknowledgment

By applying and registering as a Seller, you confirm that you:

• Are an artist or artisan residing in Eureka Springs, Arkansas.
• Have read, understood, and agreed to the Terms and Conditions.
• Accept responsibility for compliance, accuracy, and legal obligations related to your products,  listings, and presence on madeineurekasprings.com.
